I. APPLICABLE LAW

A. CONSENT TO THE TERMS OF USE

The project “Communities & Commons” (“Project”), proposed by Danish Cultural Institute (ICD), informs that to make use of any of our Interactive Services, such as website, platform, internet applications, you (“User”) declare to have read, understood, and fully agreed with the Terms of Use (“Terms”) set forth herein, and to have registered by providing true personal data. Finally, the User also acknowledges that it has read, understood, and agreed with DCI’s Privacy and Cookies Policy.

At DCI’s sole discretion, the provisions of these Terms may be changed at any time.

B. WHO CAN REGISTER

The User can be any private individual who has the civil capacity to register. Legal entities can also register through their legal representative. People who do not enjoy full civil capacity, including children and adolescents, cannot register.

User registration is unique, personal, and non-transferable. Access to the User account will take place through the username and personal and non-transferable password created by the User at the time of registration. Therefore, the custody and protection of these access data is the sole and exclusive responsibility of the User, who may be held responsible for any misuse.

The provision of data when completing the registration is the User’s sole and exclusive responsibility. Thus, the existence of untrue or outdated data, in addition to legal liability, may result in the User being excluded and/or blocked from using our Interactive Services.

DCI, at its free and exclusive discretion, and without prior notice, reserves the right to request data and/or documents from Users; delete and/or block the User who violates the Terms or the Privacy & Cookies Policy of DCI.

C. OUR RULES OF CONDUCT

DCI supports honest and open conversations on the website and insists on respectful, inclusive, and constructive debate. Thus, the User undertakes not to use our interactive Services to:

i. Share, publish, create, store and/or disclose content that is abusive, vexatious, defamatory, libelous, explicit, pornographic, that incites hatred or violence against people or groups, or that contains religious or racist insults or threats, or that encourages moral damages, property damage, or that may violate any third-party’s rights, notably human rights;

ii. Share, publish, create, store and/or disclose defamatory or libelous information or that contradicts the honor, the personal and family intimacy, or the image of people (including legal entities, entities and organizations similar to it);

iii. Share, publish, create, store and/or disclose products or services for profit;

iv. Share, publish, create, store and/or disseminate advertising banners and/or any type of electronic commerce that is contrary to the legislation, or even if lawful, has a direct or indirect advertising or commercial purpose, without the prior authorization of DCI, under penalty to answer for reasonable losses and damages;

v. Share, publish, create, store and/or disseminate content or comments that are too far removed from the discussion topic;

vi. Practice falsehood, understood as false information (for example, deliberate and voluntary disclosure of information that the User knows to be false or that is clearly false) and malicious falsehood;

vii. Use robots, “spiders”, or any other device, automatic or manual, to monitor, modify, adapt, translate, copy, reverse engineer, decompile or disassemble any content from our Interactive Services;

viii. Carry out any type of malicious software dissemination, attack, or invasion, regardless of purpose, without prior authorization from DCI. Any failures in the Interactive Services found during its use must be reported responsibly and confidentially directly to DCI, by email at webmasterbr@commonities.org;

ix. Reproduce, copy, alter, modify, sell any of our Interactive Services or part of the content, without express authorization from DCI or the content author;

x. Practice conduct that can be characterized as “spam”;

xi. Promote or otherwise address specific political parties or candidates;

xii. Violate or infringe the Brazilian law;

xiii. Assist or encourage any third-party to perform any of the actions prohibited by these Terms;

D. CONTENT REMOVAL

DCI reserves the right to withdraw, partially or totally, without prior notice, content that violates the Terms, DCI’s Privacy and Cookies Policy, the rules of conduct and the Brazilian legislation.

E. BLOCKING OR EXCLUDING INTERACTIVE SERVICES

DCI reserves the right to block or exclude the User’s access and/or account to the Interactive Services in case of violation of the Terms, the Privacy Policy and Cookies, by court order and by the police or the administrative authority. However, if the User wishes, it may contest it, through the channels made available on the Interactive Services.

F. INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHT

DCI respects the intellectual property rights of third parties, as well as copyrights, and requires the User of Interactive Services to do the same.

Thus, when using the Interactive Services, the User undertakes not to copy, modify, use, or disclose, in whole or in part, texts, articles, programs or any other material, without the permission of its author.

DCI authorizes the free printing of the content in the “an open source exhibition” section. If you are interested in using other contents of the Project, please contact DCI.

The content that the User publishes in the activities that take place on the Interactive Services (exercises, discussion forums, etc.) is information that, by its nature and characteristics, is public, open, and non-confidential.

G. REPORTS OF ABUSE OR VIOLATIONS OF THE TERMS

We advise the User to report any abuses or violations of these Terms or any violations of third- party rights occurring in the Interactive Services.

H. RESPONSIBILITIES

When sharing, publishing, creating, storing and/or disclosing any content, the User acknowledges that it is its entire responsibility, exempting DCI from any responsibility. Such opinions and/or content do not necessarily reflect the opinions of DCI.

Thus, DCI will not be responsible for any damages or losses suffered by Users or third parties that, regardless of the manner, originated in our Interactive Services.

I. APPLICABLE LAW

The law of Brazil will govern all disputes that arise in relation to the Terms and the Privacy and Cookies Policy. Finally, the Court of the Judicial District of São Paulo is elected to settle any issues of these Terms, excluding any other, however privileged it may be or may become.
